Yesterday, it was announced that 3 companies belonging to the Katoen Natie group were convicted by the court of first instance.<\/p>\n
The court was asked to decide whether tax authorities were entitled to 30% of these companies\u2019 distributed profits \u2013 which the authorities believed should be paid to them \u2013 or if the Katoen Natie companies could instead reinvest this money into their activities and the group’s growth.<\/p>\n
Without the court having consideration of the factual and legal arguments put forward by Katoen Natie, without taking into account European legislation on the matter, to our surprise,\u00a0the court decided in a judgment, that was not very reasoned, to follow the tax authorities.<\/p>\n
The Katoen Natie companies involved are appealing against this.<\/p>\n

Zoals U gisteren vernomen hebt, werden 3 ondernemingen behorende tot de Katoen Natie groep veroordeeld door de rechtbank in eerste aanleg.<\/p>\n
De vraag die aan de rechtbank was voorgelegd ging er over of de fiscus recht had op 30% van de uitgekeerde winst van deze bedrijven, waarvan ze vond dat dat aan haar moest uitbetaald worden of dat deze Katoen Natie ondernemingen dit geld terug mocht investeren in haar activiteiten en de groei van de groep.<\/p>\n
Zonder dat de rechtbank rekening heeft gehouden met de feitelijke en juridische argumenten die Katoen naar voor heeft gebracht, zonder rekening te houden met Europese wetgeving terzake, heeft tot onze verbazing, de rechtbank in een weinig gemotiveerd vonnis beslist om de fiscus te volgen.<\/p>\n
